Brown appoints Leslie Lohse to California State Athletic Commission

SACRAMENTO — Leslie Lohse of Glenn has been appointed to the California State Athletic Commission by Gov. Jerry Brown.

The announcement was made today.

She is a member of the California Tribal Business Alliance, and tribal council treasurer of the Paskenta Band of Nomlaki Indians since 1998.

She is a member of Rolling Hills Clinic board of directors and member of Tehama County Girls Inc. She also was chair of the Bureau of Indian Affairs Central California Agency Policy Committee, and Bay Delta Public Advisory Committee, among others.

Her appointment requires Senate confirmation.

One year ago, Governor Jerry Brown’s office appointed Leslie Lohse, the mother of baseball pitcher Kyle Lohse, to the California State Athletic Commission board. Here was our reaction & background information on the political appointment. Lohse, who was the treasurer of the Paskenta Band of Nomiaki Indians in Tehama County (a couple of hours north of Sacramento), was someone who might have been viewed as an asset to help the Athletic Commission negotiate with tribes running combat sports events without CSAC regulation. In other words, there was an internal belief in some Sacramento circles that she could have helped out with venues like Lemoore (Tachi Palace) in getting CSAC oversight of events back on track.

Lohse also was involved in the debate over online gambling, politicking against New Jersey’s online gambling efforts. Here is a glowing online profile of Lohse.

Instead of being an active player at CSAC meetings, Lohse vanished in a hurry and mysteriously never was brought into the Athletic Commission fold. And now we know why. The reasons are explosive.

The Sacramento Bee reported on Friday that a judge has issued a temporary restraining order against rival, armed factions at the Rolling Hills Casino that Lohse was heavily involved in making a success. Lohse was reportedly suspended as treasurer after being accused by tribal Chairman Andy Freeman of embezzling a lot of money & misusing the Paskenta tribe’s jet. The judge issuing the TRO is apparently on the side of new management. The superintendent of the Bureau of Indian Affairs’ Central California continues to recognize Lohse as the tribe’s treasurer while the mediation process between the two rival factions takes place.

The story of the armed stand-off between the two tribal factions has been heavily covered in the Red Bluff, Redding, I-5 area of Northern California. The situation is disastrous and comes on the heels of the violence in Modoc County, the state’s sparsely-populated Northeastern county. Here’s Courthouse News:

The General Council also removed four of the five members of the Tribal Council – Leslie Lohse, David Swearinger, Geraldine Freeman and Allen Swearinger – leaving only Chairman Andy Freeman.

The General Council elected four new members to replace those who left. The Tribal Council is now led by Andy Freeman, who secured the casino with hired, armed security, according to the Observer.

The four ousted members maintain that they are the duly elected Tribal Council of the Paskenta Band and have established their own Tribal Court and Tribal Police Department.

Andy Freeman also made hacking allegations against suspended tribal members. The suspended tribal members have allegedly attempted to shut down Rolling Hills Casino. In the RB Daily News article, a former sheriff is quoted as saying that the suspended tribal members wanted to shut the casino down to stop the flow of money to the new tribal leaders.

It’s no wonder that Lohse never showed up for the Athletic Commission. And it’s a demonstration of the kind of politicking in Sacramento that has created a chaotic regulatory climate in the state for combat sports. Nobody knows what the hell is going on.

Racist Van Gordon Sauter, John Frierson,  must go. They were on this CSAC commission in 2003 when all this corruption was going on. Fixed Fights, MMA was legal along with Tough Man which were approved together December of 2000.(Note proof at bottom Art Dore and Kage Kombat being approved). Art Dore was a big Tough Man promoter.  This is more proof that MMA and Tough Man were approved. Why did these commissioners hold back MMA until 2006 for Pro and 2010 for amateur when both were already approved in 2000. Why are they still around? Was it so UFC could gain full control of the sport? Also they extort taxes from WWE even when they don’t regulate fake wrestling. They say WWE volunteers giving them $300,000.00 a year not required tax.

18602.  

(a) Except as provided in this section, there is in the Department of Consumer Affairs the State Athletic Commission, which consists of seven members. Five members shall be appointed by the Governor, one member shall be appointed by the Senate Committee on Rules, and one member shall be appointed by the Speaker of the Assembly.

The members of the commission appointed by the Governor are subject to confirmation by the Senate pursuant to Section 1322 of the Government Code.

No person who is currently licensed, or who was licensed within the last two years, under this chapter may be appointed or reappointed to, or serve on, the commission.

(b) In appointing commissioners under this section, the Governor, the Senate Committee on Rules, and the Speaker of the Assembly shall make every effort to ensure that at least four of the members of the commission shall have experience and demonstrate expertise in one of the following areas:

(1) A licensed physician or surgeon having expertise or specializing in neurology, neurosurgery, head trauma, or sports medicine. Sports medicine includes, but is not limited to, physiology, kinesiology, or other aspects of sports medicine.

(2) Financial management.

(3) Public safety.

(4) Past experience in the activity regulated by this chapter, either as a contestant, a referee or official, a promoter, or a venue operator.

(c) Each member of the commission shall be appointed for a term of four years. All terms shall end on January 1. Vacancies occurring prior to the expiration of the term shall be filled by appointment for the unexpired term. No commission member may serve more than two consecutive terms.

(d) Notwithstanding any other provision of this chapter, members first appointed shall be subject to the following terms:

(1) The Governor shall appoint two members for two years, two members for three years, and one member for four years.

(2) The Senate Committee on Rules shall appoint one member for four years.

(3) The Speaker of the Assembly shall appoint one member for four years.

(e) (1) This section shall remain in effect only until January 1, 2020, and as of that date is repealed, unless a later enacted statute, that is enacted before January 1, 2020, deletes or extends that date.

(2) Notwithstanding any other law, the repeal of this section renders the board subject to review by the appropriate policy committees of the Legislature.

A 26 year veteran of the Los Angeles Police and Sheriff’s Departments, he served as Senior Traffic Supervisor for the Police Department for 17 years. He’s been a member of the Los Angeles Transportation Commission since 2001, and is currently its Vice President. Chairman Frierson is an Executive Board Member of the California Democratic Party and was a delegate to the Democratic National Convention from 1976 through 2000. He’s also the recipient of numerous Community Services Awards from both the City of Los Angeles and the California State Assembly.

The reversal of the CSAC Gift Policy tells everything you need to know about Chairman Frierson.

First and foremost, it shows that Chairman Frierson is politically untouchable in California. When you consider every conceivable measure of political power, Frierson is off the charts.

Take a second and think about what type of political power you would need to be appointed Chairman of CSAC.
Now think of how much power you would need to keep your appointment after being rocked by the CSAC Gift Policy scandal. The fact that Chairman Frierson even survived the scandal tipped his hand to the fact that he is politically elite

Now imagine the brazen balls and overlapping political power you would need to reverse the measures that were enacted as a result of the CSAC Gift Policy scandal.

Frierson successfully voted to reverse the CSAC Gift Policy so he would be able to give away expensive tickets without breaking the law. Considering that California is in a financial crisis and CSAC has been called out for abusing the gift policy in the recent past, this reversal is beyond excessive and something that only the highest level of political elite can pull off.

Chairman Frierson knows that he is powerful and does what he wants, when he wants because of it. Even if AB2100 is the best policy ever introduced to CSAC, Frierson could easily kill it for no other reason than he needs events to come to California so he can give away those free tickets. 🙂

Things are about to get chilly between California State Athletic Commission Executive Officer Andy Foster and Dana White. With an upcoming show in Sacramento, it remains to be seen if UFC will read the riot act to Mr. Foster for granting Conor McGregor a boxing license.

What we can likely guess is that McGregor getting a boxing license does not sit well with UFC management.

By granting Conor McGregor a boxing license in California, Andy Foster has opened the door for Conor McGregor to get a boxing license in other states. This would automatically create a scenario of leverage for McGregor to fight outside (or under) the UFC banner in a boxing exhibition or legitimate contest. It opens the door for issues relating to the Ali Act since McGregor would be acting in a capacity as a boxer, not an MMA fighter. The Ali Act for MMA is dead. It’s not dead for boxing. What kind of legal rights could McGregor assert if his UFC contract prohibits him from boxing?

Regardless of how slim the odds are for Conor McGregor fighting Floyd Mayweather, McGregor being granted a boxing license by Andy Foster escalates the business tension between the Lightweight champion and UFC. Adding intrigue to the storyis this reported claim that the Nevada State Athletic Commission refused to give Conor McGregor a boxing license.

The co-dependent relationship between UFC & Andy Foster

Andy Foster’s biggest ally since taking over the job at the California State Athletic Commission has been UFC. We’ll elaborate later on just how significant that relationship is and what the pressure points are.

And if you remember, Andy Foster was prepared to move from Sacramento to Las Vegas due to various reasons if it meant getting the Executive Director job at the Nevada State Athletic Commission after Keith Kizer’s departure. For both personal and political reasons. Andy and his wife were having a child. The Athletic Commission was coming off of a reported extortion attempt by crooked California senator Leland Yee in order to keep the agency alive. Yee was exposed for having connections to famous Chinatown organized crime boss Shrimp Boy. Yee was given tickets to a UFC event in San Jose.

Andy Foster ended up as one of the finalists for the Nevada job. He didn’t get it. The interview, which was done publicly, didn’t go so well. For the purposes of UFC, having Andy Foster remain in California allowed them to maintain power over both California and Nevada.

A funny thing happened, though — MMA revenues have steadily declined in California. Boxing revenue is king. The second top revenue source remains taxation on WWE, a gross abuse of the athletic commission’s authority. Taxation without real regulation. Confiscatory. WWE could easily appeal such disparate confiscation in court but have chosen not to do so. Without wrestling revenues, the California State Athletic Commission would face a financial squeeze despite the reserves they have built up in the bank.

UFC’s pressure points on Andy Foster

Andy Foster has granted a lot of people boxing licenses over the last few years. Some of them never deserved a license in the first place, like a nearly 60-year old 200-pound female boxer. Comparatively-speaking, it’s a hell of a lot less dangerous having Conor McGregor in a boxing ring than a 60-year old amateur. But granting Conor McGregor a boxing license is politically explosive with UFC.

If McGregor can parlay his boxing license into something bigger that drags UFC into a business situation they don’t want to be involved in, they’re going to reasonably point the finger at Andy Foster for giving Conor McGregor a boxing license. If UFC wants to retaliate, they have three significant economic attacks they can launch against Andy Foster.

1. Pull shows out of California

This is the easiest weapon of choice for UFC retaliation. UFC just pulled their PPV from Anaheim. Their events are the only significant MMA money makers for the state. The members of the Athletic Commission board love to act like celebrities at these events and one member in particular loves acting like a barking gloryhog with authority they do not possess. Take the fame and money away by not having as many shows in the state.

2. Stop helping the Athletic Commission with cash on lobbying efforts

This is the mutually-assured destruction option that would really screw over Andy Foster.

UFC has top Sacramento lobbying firm Platinum Advisors on a retainer. They’ve spent over $750,000 on lobbying efforts in California, with $200,000 of that cash over the last seven reporting quarters. Without UFC’s lobbyist cash, Andy Foster wouldn’t be able to get things in Sacramento at the Capitol. He just wouldn’t.

WME-IMG also spend an inordinate amount of cash on lobbying efforts in Sacramento. If WME wants to pull the plug on helping out the Athletic Commission in advancing statutes regarding weight cutting, taxes, and other safety regulations, they can do it. Nothing would destroy Andy Foster’s political power faster than UFC not spending their lobbying cash to push his agenda.

3. Remove any chance of a post-Athletic Commission golden parachute with UFC

It’s unlikely that Andy Foster is going to land another major athletic commission job given the current political terrain. Who would want to work in New York? Florida has their own bureaucratically-controlled attorney in place. Texas has new leadership. Nevada is a mess.

Which means that California is likely his last destination for an job with an Athletic Commission. If he retires or quits or gets removed from his California job, landing a golden parachute from UFC would make sense. Or at least it would have used to make sense. Lorenzo Fertitta took care of Marc Ratner and Armando Garcia.

Now with WME-IMG? That open door policy isn’t so open, especially if Ari Emanuel and Dana White see Andy Foster as helping out Conor McGregor obtain leverage in a labor spat.

When you have a family to feed and bills to pay, UFC employment used to be a very secure option with Lorenzo Fertitta. That security blanket is gone now. The venture capitalists have taken over. Andy Foster needs to keep his job in California. He can’t afford to have UFC screwing him over financially or politically. Once he’s out, he’s out.

 

Conor McGregor Obtains Professional Boxing Licence – But Why?

Today Ariel Helwani broke the surprising news that Conor McGregor obtained a professional boxing licence in California.  Andy Foster, the California State Athletic Commissions executive officer noted

He got a license today and a federal ID…He’s a California boxer now….He’s qualified [as a boxer]…I’d love to see him fight in California. It just needs to be the right opponent. Certainly a high-level opponent. We’re happy to license him. We’re happy he’s a California fighter.

So here is the multi-million dollar question – Why?  Perhaps its an attempt to keep his name in the press, perhaps its a simple negotiating tactic or perhaps its something far more clever and interesting.

McGregor remains under contract with UFC parent company Zuffa.  His contract likely has exclusivity provisions prohibiting him from competing in other combative sports.  Specifically, Zuffa contracts contain the following provision

During the Term, Zuffa shall have the exclusive right to promote all of Fighter’s bouts and Fighter shall not participate in or render his services as a professional fighter or in any capacity to any mixed martial art, martial art, boxing, professional wrestling, or any other fighting competition or exhibition, except as otherwise expressly permitted by this Agreement“.

Given his unparalleled financial drawing power for the UFC it is more than unlikely that they would simply let him walk away to compete in boxing.  He would be promptly sued and this is where things get interesting.

Now that McGregor is a licensed professional boxer in the US he enjoys all the protections of the Muhammad Ali Act.  If you are unfamiliar with this legislation you can click here for a section by section breakdown of all the protections it grants boxers which MMA fighters do not enjoy.

If McGregor tries to box and is met with a Zuffa lawsuit and injunction application he can try to shield himself with the protections of the Act.  He can argue that he is a professional boxer and his restrictive Zuffa contract violates numerous provisions of the Federal legislation. To the extent that his Zuffa contract seeks to restrict him from earning a living as a professional boxer he may be on to something.  Zuffa would, on the other hand, argue that they do not meet the definition of a professional boxing “promoter” under the legislation and that it does not apply to their McGregor contract.

Will McGregor’s strategy work?  Who knows.  Its a long shot.  But it is also a potential power play.  It is leverage.  It is a unique move.  McGregor has expressed an interest to take a break from competing until after his first child is born.  This may be a perfect opportunity to get litigation underway for judicial interpretation.  Interesting times.

There is no Neurological Company under contract and they haven’t Neurological tested any fighter since 1998. This was the year a Draka fighter died at the Forum because no test was performed. How can they tax for safety precautions and not use money it was intended for. Recent response to my other public records request concerning company under contract. By law to tax for neurological testing a company must be under contract. This is complete extortion.

In the superseding Federal indictment, the court document alleges that Leland Yee talked with someone regarding SB309 on March 2nd, 2013 and that he “did a number” on that person, which allegedly led to Yee’s fundraiser Keith Jackson supposedly soliciting Individual A for lobbying cash in exchange for a Yee “yes” vote. A few days after that initial contact, the indictment claims that an Individual B arrived with A and was allegedly being solicited for donations to Yee’s campaign and to bring in others who would also supposedly contribute money to Yee.

Any sort of payment made directly to Keith Jackson Consultancy for lobbying would not be publicly disclosed unlike direct campaign contributions made to Leland Yee.

The indictment also accuses Yee and Jackson of “extorting individuals related to the California State Athletic Commission and the Mixed Martial Arts industry regarding retaining the existence of CSAC and its ability to regulate certain sports in California.”

Yee allegedly told an unidentified individual who wanted the commission to keep operating, which allowed it to continue permitting mixed martial arts fights, that he should hire Jackson as his lobbyist to win approval of a bill that extended the commission’s operations. Yee told the individual he was thinking of voting against the bill but ended up voting for the measure.

SACRAMENTO – Assemblywoman Melissa A. Melendez’s, R-Lake Elsinore, announced today Senate Democrats  demonstrated support for political and criminal corruption by killing her legislation, Assembly Bill 1788, designed to provided whistleblower protection to legislative staff and root out corruption.

This year, two former Democrat State Senators were sentenced to prison for crimes they committed during their time in the legislature, and yet the Democrats do not believe corruption is a problem, said Melendez.“Apparently, accepting tens of thousands of dollars’ worth of bribes and gunrunning shoulder fire rockets aren’t matters of concern for the Democrats.”

Under current law, the California Whistleblower Protection Act provides protection to state employees in the executive and judicial branches who report any improper or unethical governmental activity. However, employees of the Legislature are not covered under this act.

Assembly Bill 1788 would have extended those whistleblower protections to legislative staff who report illegal or unethical behavior in the Legislature.

This is Melendez’s third iteration of this legislation. The prior two versions also received unanimous support in the Assembly and subsequent Senate policy committees, yet were killed by Democrat leadership in the Senate Appropriations Committee.

“It is clear the Democrats do not want to stand up to corruption.  It’s also clear they want to continue to protect one another as their former caucus members prepare to serve prison sentences,” Melendez said.“What is even more appalling is the Democrats believe eradicating corruption is too expensive. But, wasting $100 billion on High-Speed Rail isn’t? It is shameful how misguided the Democrat majority’s priorities really are.”

How can John Frierson still be on Commission.  So sad to look at him in this meeting he is mentally not there. He should by law be termed out. John Carvelli had to direct him where the Flag is. He is clueless.

 


How was John Frierson allowed to be on CSAC since 2001. Over 15 years on commission and by law he should be allowed only 4 years. Frierson said at one CSAC meeting that he only got on CSAC to get a Black Man as a inspector and that was Larry Irvin. This CSAC inspector required promoters to let him know who the winners and losers were before the fights began at early MMA fights.

Everyone understands the seriousness of the debt crisis in California and the position that the California Democratic Party is in. Because California is a one-party political state, a lot of power is consolidated in certain geographic areas – most of it in the big cities west of I-5. John Frierson happens to be a very old-school player in California Democratic Party circles. Frierson has been a member of the CSAC since 2001. To understand how uncommon the length of Frierson’s tenure on the Commission is, you have to look at the rules for membership appointment. You can be appointed to the CSAC via one of three avenues – 1) by the Governor, 2) by the Assembly Speaker, or 3) by the Senate Rules Committee.

  • The Governor can give an appointee a length of anywhere from 2 to 4 years.
  • The Senate can give an appointee a length of 4 years.
  • The Assembly Speaker can give an appointee a length of 4 years.

The reason we point this out for your consideration is because in order for Chairman Frierson to be kept on the CSAC board for as long as he has been, he must be someone of substantial political value. Given his 40+ year political relationship with Governor Jerry Brown, it’s easy to see why John Frierson will remain Chairman of the CSAC for years to come. Although his term expires on January 1st, 2015, the safe bet is that Chairman Frierson will stick around as long as he is in good health.

Why do we even have a commission. They don’t care about health and safety. They have been taking in money for years from neurological fund but don’t use it to scan fighters. They don’t pay pension collected to Boxers and especially MMA fighters. They claim no head striking Pankration Full Contact and over regulate it while allowing kids as young as 5 strike the head and say it’s light contact. They don’t pay fighters there money once they collected from promoters. They require promoters to give them a list of winners and losers before fight begins. They get caught stealing $100,000.00 from the neurological fund the same week Senator Leland Yee’s office contacts them and Leland Yee all of a sudden changes his mind on sunsetting the CSAC. Just read everything on this site.

Here is Antonio McKees Story on CSAC. It was bad then and worse now than it ever has been.

In 2006 Antonio McKee fought in a CSAC sanctioned event. The CSAC gets a bond from promoter to cover all fighters purses. Antonio went to a CSAC meeting in October which I was there also and requested to get paid to the Commission where six are appointed by the Governor, one by the Senate rules committee, and one by the speaker of the assembly. When he addressed them they said contact Dave Telephone Thorton and he will take care of this matter. I heard them say this. Well Antonio McKee called me and said Dave Thorton was playing MIA. Finally he got in touch with him and asked him about his pay. Dave said Chalk it up as a loss. This is so wrong the CSAC is getting money to cover the fighters pay and don’t pay them. There is no concern for the fighter. I also talked to another fighter from Antonios gym that wasn’t paid either. He had to get an attorney to get paid. Was promissed it two weeks ago but still hasn’t received it. His attorney told him to contact Gil Deluna of the CSAC. Fighters now have to get attorneys to get paid if they can’t afford them they have to chalk it up as a loss. Sometimes the attorney fees are more than the fighters purse so they don’t bother. This is one reason now that C.A.M.O. was formed the fighters don’t get paid and fight on Pro Boxing Cards where they sell more tickets than the Pro Boxers and only the Pro Boxers get a pension and brain scan if ever. The Amateur MMA fighter ticket sells get taxed for Pro Boxers Pension Fund and Neurological Fund but all that money goes into the CSAC secret slush fund.

I was at CSAC meeting in October when the CSAC told Antonio to contact Dave Thorton of the CSAC to get paid. He fought at a CSAC sanctioned fight and was never paid. Dave Thorton told Antonio McKee to chalk it up as a lost. Where is the money and bond the promoter paid. The CSAC is suppose to be there for the Health and Welfare of the fighter. What a joke of a commission telling him to chalk it up as a lost..

This letter was sent to me by a promoter. I took off his name because he was afraid of being blackballed by the corrupt commissions.

These are some of things that were done by the commission which disrupted the show.

1. Without my permission wrote on my personnel check without me witnessing and distributed to fighters. This was done by three different people I am assuming one of them was not in the commission.

2.Lost of paperwork that was sent by fax to the commission that caused a loss of matches.

3. Charging me $1000.00 dollars for filming which was not done by TV, cable and was not on Pay per view.

4. To this day I have 0 receipts for anything even the fighters contract, which was was given to the fighters the night of event so I dont know what I paid for?

5. I also have 0 receipts for all fighters that paid cash to the commission which took money from them.

6. Charged me 25% of comp tickets from a wrong number which I still don’t know because I don’t have any receipt.

8. Lastly I want to know why I have three different hand writings on my personnel checks that was faxed by fighters. I only know of two commission members, who was the third person that wrote on my checks. Do they just authorize anyone to sign peoples check without permission?

10. Lastly the constant threats to shut down your show and the abuse of power that disrupts the promoters ability to conduct business is just plain wrong.

More fighters not being paid by CSAC!

What happened to the $50,000.00 Bond the Promoter is required to put up to cover these problems? Why is now the video being blocked? 

Crystal was not paid the money she was promised on the bout contract. The other fighters on the card weren’t paid, either. Some of them came from out of state to fight on the show. This situation should have never happened in the first place, thanks to Che Guevara. However, it happened. Since it happened, the onus is on the front office to use an ounce of common sense and do their jobs.

1. Suspend the license of Raul Orozco.
2. Give the $50k bondholder information to the fighters to hit the bond.

These two actions, simple in nature, would have taken approximately 15 minutes to execute. This is kindergarten-level stuff we’re talking about here. Ice out Orozco’s promoter license and let the fighters do what they have to do in order to get paid the money they were owed.

However, this is the Department of Consumer Affairs we’re talking about here and they managed to screw up an easy situation and turned it into a horrific situation for the victims involved in the matter.

Watch April CSAC meeting on Page Below and notice CSAC scrambling now to pay pension only after I discovered money missing from neurological fund in e-mail. They don’t even put it directly in the Pension account which they never touch. CSAC has a new secret account they put it into to run daily operations. (Andy Foster admits in video). I have been battling this Boxers Pension Fund issue since 1998. Started again when I was Sgt at Arms at ILWU Hall and ex Boxers were telling me they haven’t got there pension. I gave them the number to call 1-916 263-2195. They called and said when they called the CSAC staff member said the money was lost, stolen or misplaced, good luck.

This CSAC is just waiting for all the Boxers to pass so they will never have to pay out funds.

Millions of dollars is there to be given out but the Legislature and the Governor’s office won’t give more than 100,000 in spending authority in a year? By that standard, it would take 50 years to give away the money.

I don’t buy for a second that CSAC/DCA could withstand a forensic audit of the boxers pension/neurological fund, especially given what has happened with the Parks & Recreations Fund scandal that blew up in Governor Jerry Brown’s face. With California having over 500 special funds and politicians having so much cash at their disposal, abuse & fraud is ripe.

SACRAMENTO (CBS13) — A famous boxer from Sacramento tried to get his pension from the state.
But when he couldn’t get straight answers, he called Kurtis.
He’s Tony “The Tiger” Lopez, a three-time world championship fighter.
California has a pension fund for boxers but Tony thinks he’s being shorted.
“This was my first title fight with Rocky Lockridge, fight of the year,” said Tony Lopez, three-time world championship boxer.
Tony was just 25 years old when he won his first world championship title.
Now a decorated and retired fighter at age 50, he’s qualified to collect his pension.
Back in 1982, California started the pension fund for boxers who fought at least 75 professional rounds in the state.
But Tony recently found out his pension amount, about $34,000, was only a bit more than his brother’s, Sal Lopez.
But Tony says after the pension program started, he fought three times as many fights as Sal.
“How am I only getting $2,000 more than my brother? Oh well we don’t know how they calculate it. Well, however they calculate it, it’s not right,” said Tony.
We asked the commissioner of the California Athletic Commission, which oversees this fund, why the numbers didn’t seem to add up, and he initially wasn’t sure how the pension fund was calculated either.
“It’s a very complicated formula,” said Andy Foster, Executive Officer, California Athletic Commission.
We then contacted San Diego law professor, Bob Fellmeth, who wrote the law for this pension fund.
He told us the number of rounds fought did make a difference.
So we went back to the Commission, they found a provision in the law, allowing Tony’s brother’s 21 fights before the pension program started, to count.
“Once you count those fights, it brought the number of bouts to a very even number,” said Foster.
Which is why their pensions are about the same.
Tony has since received his pension check in full and is glad to finally get answers.
“I’m a three time world champion because I don’t quit. I never said I was the best fighter in the world but I tell you what, I don’t quit,” said Tony.
Since 1996, this pension program has been funded soley from ticket sales.
Right now, California is the only state that has a boxers pension fund.
There is $5.3 million currently in the fund. But the Commission tells us they can’t find more than 150 boxers who are entitled to share roughly $2 million. So they want to get the word out about this pension available.

Recommendation:

Boxers have three years to claim their benefit before the Commission is required to forfeit. The Commission should do everything it can to reach out and contact boxers and pay their benefits before they are forfeited. The Commission may want to consider utilizing the Social Security Administration and the Internal Revenue Service features that are available to locate individuals that are due a retirement benefit. For example, a boxer becomes eligible at age 50 to receive their retirement distribution and the Commission must forfeit their benefit at age 53. If the commission does not hear from the boxer by age 52, the Commission could utilize the services stated above to help locate the boxer. As a result, the Commission would reduce the likelihood that a significant number of boxers will re-claim their forfeited accounts to the detriment of current year contributions and allocations. The Commission may want to consider other funding mechanisms to further mitigate the risk of current year contributions not being sufficient to cover lost beneficiary claims in any given year.

CSAC Allegedly Extorting Money from MMA fighters to pay into Boxers Pension Fund and Neurological Fund

Cinco de Mayo extortion. Underground fight.  Today the CSAC/CAMO is holding a underground fight where no public tickets are sold. The Amateur fighters fighting on fight card are being used and abused they are selling more tickets than the Pro Boxers.  The CSAC will be taxing for Pro Boxers Pension and Neurological Fund from the Amateur MMA fighters but only the Pro Boxers will benefit.  No money will go for the Amateur MMA fighters. They receive no pension or brain scan. They strike the head just as hard as pro fighters. They are being sacrificed by CSAC/CAMO to keep boxing alive. This is a violation of equal rights. Imagine if your Mexican and work for a White Company. You have money taken out from your paycheck for a Pension and Medical for years but when you retire only the white workers get a huge payout you are screwed. This is what the State of California is allowing to go on today in Orange County.

The administrative complaint was filed against Englebrecht on May 3rd, giving him 20 days to respond before the meeting on May 25th. Nevada wants action taken against Englebrecht’s promoter license along with investigative costs & attorney’s fees.

The major question after May 25th is whether or not the California State Athletic Commission, which is Roy’s home turf, will enforce Nevada’s license suspension. There’s a lot of money at stake and California is legally not obligated to follow the suspension of a boxing promoter in another state. If California chooses to ignore Nevada’s suspension, it will spark political tension between the two states.

To be able to fight pro MMA for a Pro Boxing/Pro MMA event the MMA fighters are told they must sell a certain amount of tickets to be able to fight on the card. Money is taken for a Pro Boxers Pension and for a neurological fund that is never used. Also at Pro MMA only events money is taken for neurological fund and never used.
